General Conditions of Sale — Digital eBooks

These General Conditions of Sale (“Terms”) apply to purchases of digital eBooks and related downloadable digital materials offered by Cyber Wolfdog Trading (“CWDT”) through ebooks.cyberwolfdogtrading.com (the “Website”).
By placing an order, you agree to these Terms.
Mandatory consumer rights under applicable law remain unaffected.
1. Company Information and Scope
The Website and digital products are offered under the brand Cyber Wolfdog Trading, operated as part of Chiwi’s IT.

These Terms apply to natural persons and legal entities purchasing standalone eBooks or related downloadable digital products from CWDT.
Where eBooks or digital educational materials are supplied as part of a CWDT Membership, subscription or other bundled CWDT service, the applicable CWDT Service Terms also apply.
In the event of a conflict concerning a Membership or bundled service, the specific provisions of the CWDT Service Terms governing that Membership or service take precedence, while these Terms continue to govern the permitted use and intellectual-property protection of the applicable eBook or digital material where relevant.
CWDT's digital educational products are not specifically directed at children.
A minor may purchase or use a digital educational product only where permitted under applicable law and subject to any legally required involvement, consent or authorisation of a parent or legal guardian.
2. Products, Orders, Prices and Payment
CWDT may offer digital products such as:
eBooks;
PDF documents;
educational downloads;
related digital materials expressly included with a product.
The product description shown on the Website at the time of purchase determines what is included.
An order is completed when:
the Customer completes the applicable checkout;
payment is successfully processed; and
the order is confirmed and/or access to the digital product is provided.
CWDT may refuse, suspend or cancel an order where reasonably necessary because of suspected fraud, payment failure, abuse, technical error or unlawful activity.
Prices are displayed in the currency stated during checkout.
Applicable VAT or other taxes may depend on the Customer's country, customer status and applicable tax rules.
Prices may change for future purchases.
The price applicable to an order is the price displayed to the Customer when the order is placed, subject to correction of obvious pricing or technical errors where permitted by law.
Payment is due through the payment method offered during checkout.
Payments are processed through external payment providers.
CWDT does not store full payment-card or bank-payment credentials.
3. Digital Delivery and Technical Requirements
Products covered by these Terms are supplied digitally and are not physical goods unless expressly stated otherwise.
Following successful payment, delivery may take place through:
a download link;
an order or confirmation page;
email instructions;
an applicable digital environment;
another electronic delivery method stated during checkout.
Digital content is considered supplied when the digital file, download facility or other appropriate means of accessing the purchased content has been made available to the Customer in accordance with applicable law.
Customers are responsible for having suitable equipment and software capable of opening the stated digital file format, such as PDF.
Where specific compatibility, functionality or technical requirements apply, CWDT may state them on the relevant product page or during checkout.
If a Customer experiences a genuine technical problem accessing a purchased product, please contact:
CWDT will reasonably assist with legitimate delivery or access problems.
4. Withdrawal Right, Immediate Digital Delivery and Refunds
Consumers in the EU/EEA
Consumers purchasing digital content at a distance may have a statutory withdrawal period under applicable law.
For digital content that is not supplied on a tangible medium, that statutory right of withdrawal may be lost once supply begins, but only where all applicable legal requirements have been satisfied.
Immediate Digital Delivery
Where you request immediate access to digital content before expiry of the statutory withdrawal period, you will be asked during checkout to:
expressly consent to immediate supply of the digital content before expiry of the statutory withdrawal period; and
acknowledge that you lose the applicable statutory right of withdrawal once supply begins in accordance with applicable law.
The right of withdrawal is lost only where the applicable statutory requirements have been satisfied.
Where legally required, confirmation of this consent and acknowledgement will be provided to you on a durable medium, such as the applicable order confirmation or email.
Refunds after valid immediate digital delivery
Once:
the digital product has been supplied;
the Customer validly requested immediate supply;
the required express consent and acknowledgement were obtained; and
the applicable statutory withdrawal right has validly been lost,
the purchase is final.
CWDT does not provide a refund merely because the Customer changes their mind, no longer wants the eBook, does not read or use the product, expected different educational content where the supplied product corresponds with its description, or lacks suitable software or equipment where applicable technical requirements were reasonably disclosed.
Mandatory consumer remedies remain unaffected
Nothing in these Terms excludes or restricts mandatory statutory consumer rights.
If paid digital content is not supplied as agreed, is defective, is inaccessible due to a fault for which
CWDT is responsible, or does not meet applicable legal conformity requirements, the Customer may have statutory remedies including, where applicable:
having the digital content brought into conformity;
corrected or replacement access;
a proportionate price reduction;
termination of the contract and reimbursement.
CWDT may first be given a reasonable opportunity to investigate and, where appropriate, correct a genuine technical or conformity problem, except where applicable law provides an immediate remedy.
5. Licence and Permitted Use
Purchasing an eBook or other digital product does not transfer ownership of the underlying intellectual property.
Unless expressly stated otherwise, the Customer receives a:
personal, non-exclusive and non-transferable licence
to use the purchased digital content for their own lawful purposes.
Without prior written permission from CWDT, the Customer may not:
share the digital product with others;
resell it;
redistribute it;
publish it;
upload it for third-party access;
forward it;
reproduce it for distribution;
make the product or substantial parts of it available to others, publicly or privately;
remove or obscure copyright, ownership or branding notices.
A licence purchased by one Customer does not automatically permit use or distribution throughout a company, group, community, course, membership, website, organisation or other third-party environment.
Unauthorised copying, sharing or distribution may result in termination of access and may constitute an infringement of intellectual-property rights.
6. Intellectual Property
Unless expressly stated otherwise, intellectual-property rights in CWDT eBooks, written content, designs, graphics, logos, educational materials and other original CWDT content are owned by or lawfully licensed to Cyber Wolfdog Trading / Chiwi’s IT.
Third-party names, trademarks, products, software and materials remain the property of their respective owners.
No intellectual-property rights are transferred to the Customer other than the limited licence expressly granted under these Terms.
7. Educational Content, Trading Risk and Third Parties
CWDT eBooks and educational materials are provided for general educational and informational purposes only.
They are not presented as personalised financial, investment, legal or tax advice.
Trading, investing and the use of Expert Advisors or other trading technology involve financial risk.
Past performance, historical results, backtests, demonstrations, reviews or examples do not guarantee future performance.
The Customer remains responsible for their own decisions and risk management.

CWDT materials may refer to third-party brokers, Expert Advisors, VPS providers, software, platforms, tools, products or services.
Third-party products and services remain subject to their own terms, pricing, availability, operation and privacy policies.
Some links, recommendations or discount codes may involve affiliate, referral or partner relationships from which CWDT may receive compensation.

8. Technical Availability and Liability
CWDT takes reasonable measures to provide purchased digital products and maintain appropriate delivery processes.
However, uninterrupted availability of the Website, email systems, hosting providers, external payment systems or third-party platforms cannot be guaranteed.
Where a genuine download link expires or a Customer loses access to a legitimately purchased product, CWDT may reasonably assist with restored access, subject to appropriate verification and continued availability of the product.
To the maximum extent permitted by applicable law:
CWDT is not liable for indirect or consequential loss resulting from use of an eBook or the Website;
CWDT is not liable for trading or investment losses arising from decisions made using educational or informational content;
CWDT is not responsible for failures, changes, interruptions or outages attributable to third-party services outside CWDT's reasonable control.
Where liability may lawfully be limited, CWDT's aggregate contractual liability relating to a particular digital-product purchase will not exceed the amount paid to CWDT for that product.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law or restricts mandatory consumer rights.
9. Privacy and Personal Data
Personal data relating to Website use, orders, payments, digital delivery, downloads and customer support is processed in accordance with the:

CWDT does not store full payment-card or bank-payment credentials.
10. Changes, Governing Law and Contact
CWDT may update these Terms from time to time.
The Last updated date identifies the current published version.
For an individual purchase, the version applicable at the time the Customer placed the order generally governs that purchase, subject to mandatory applicable law.
These Terms are governed by the laws of The Netherlands.
Where the Customer is a consumer, mandatory consumer-protection rules and mandatory jurisdictional rights applicable to that Customer remain unaffected.
Disputes will be submitted to the competent court determined in accordance with applicable law.
